Latest news on Rule of Six and Track and Trace

Just as the industry had managed to claw back half of its usual trading,
rising Covid cases in parts of England led the Prime Minister to take
action, effectively halting any progress for reopening further parts of
the industry - mainly nightclubs, conferences and events - and has
introduced the 'Rule of 6'. UKHospitality urged [3] the Government to
include roadmaps for a return to trade for nightclubs.

In addition, from Monday, it will be mandatory across all the devolved
nations to collect customer data. Scotland launched their test and trace
app this week and the NHS Track and Trace app for England and Wales will
launch on 24th September.

UKHospitality is seeking clarity as to whether businesses will have to
collect data of every person visiting the premises or just one from each
group. Once we have clarification, we will update our FAQs [4].

Finally, our survey which looks to measure the state of the nation for
hospitality closes on Monday. We urge all our members to complete the

RULE OF 6

  The new rule announced by the Prime Minister [6] on Wednesday means
that in England, no more than 6 people from 6 different households may
meet indoors or out. This replaces the previous 2 household rule indoors
for pubs and restaurants and caps table size at 6 and this is now to be
legally mandated, rather than just in guidance.

COVID-19 Secure venues
Hospitality venues may safely hold more people in the venue provided
that groups of no more than 6 congregate. It was made clear that the
onus is on operators to avoid inadvertently facilitating a larger
gathering by maintaining social distance between tables and preventing
mingling. Fines will be levied against hospitality venues that fail to
ensure their premises remain COVID Secure.

Exemptions
There are exemptions [7]for wedding receptions, wakes, other religious
life cycle ceremonies (where up to 30 people may attend), organised
indoor and outdoor sports and exercise classes as well as exercise
allowed under gyms which are Covid secure - guidance here [8]. There is
also an exemption for business and work related activities. The guidance
also clarifies that COVID-19 secure venues can continue to host people
up to their social distancing capacity but that no one can visit in a
group of more than 6; we have sought clarification around hosting of
business meetings and will update our website Covid page when we get
clarification.

Guidance
The official Government guidance for working safely during coronavirus
(COVID-19) [9] has been updated. Additional specialised advice has also
been updated, including the Visitor Economy guidance [10] and guidance
for Restaurants, pubs, bars and takeaway services [11]. The frequently
asked questions [12] have also been updated to support the new guidance.
Some points of relevance for tourism include: people can still go on
holiday in England but they should not go on holiday with people outside
their household (including +1 bubble) in a group larger than 6 people.
UKHospitality is updating its comprehensive guidance [13]and FAQs, [14]
which will be available to view shortly.

Coach tours
Coach tour providers have experienced cancellations following the
announcement of the new measures. UKHospitality is of the understanding
that coaches can operate to their Covid Secure capacity provided that
each individual party on the coach complies with the Rule of Six and
social distancing remains between each party. Once off the bus, each
individual party must stay socially distanced and enter any
attraction/accommodation or otherwise as an individual party complying
with the Rule of Six. A tour guide can take up to 30 people from the
coach on a walking tour around an attraction - once again the people
must stay in their individual groups that comply with the Rule of Six
with social distancing between them.

Enforcement
The Government will boost the enforcement capacity of local authorities
by introducing COVID Secure Marshalls to help ensure social distancing
in town and city centres, and by setting up a register of Environmental
Health Officers that local authorities can draw upon for support.

The Government will restrict the opening hours of premises, initially in
local lockdown areas, with the option of national action in the future.

MANDATORY TEST AND TRACE DATA COLLECTION

  From Friday 18 September, the law will also change to mandate
hospitality businesses to collect test and trace data from customers,
visitors and staff. Section 2.1 of the restaurants, pubs, bars and
takeaways [15] guidance states that businesses must ask one member of
every party who visits the premises to provide their contact details to
assist NHS Test and Trace, however, UKHospitality is seeking clarity on
this. The legal requirement for businesses will be to have a system in
place and to ensure details are captured. Check 'Maintaining records of
staff, customers and visitors to support NHS Test and Trace [16]' for
details of existing guidance. Further details are likely to be published
early next week and we anticipate that it will also be expected to
recommend a refusal to serve should a customer refuse to give details.

solutions to support implementation and help operators introduce contact

NHS COVID-19 APP

  The NHS Covid-19 app currently being trialled will launch on Thursday
24 September in England and Wales. Following the launch customers in
England will be able to check-in on entry with their phone instead of
filling out a check-in book or tool specific to a business. This will
allow NHS Test and Trace to contact customers with public health advice
should there be a COVID-19 outbreak.

Businesses who are already using their own QR system are being
encouraged to switch to the NHS Test and Trace QR code. An alternative
check-in method must be maintained to collect the contact details of
those who don't have the app, for example a handwritten register.

Businesses across England and Wales are being urged to ensure they have
NHS QR code posters visible on entry so customers who have downloaded
the new NHS Covid-19 app can use their smartphones to easily check-in.
Businesses can download the QR codes at

SCOTTISH UPDATE

  The Scottish First Minister announced [21] a tightening of the rules
restricting gatherings indoors and outdoors to a maximum of six adults
from no more than two households (children under 12 are excluded from
the calculation of gathering size). The new rules will take effect from
14 September and replaces the current limits of 8 people from up to 3
households indoors and 15 from five households outdoors.

She also announced that face coverings will become mandatory for
customers and staff within hospitality businesses. Customers will be
required to wear a mask when entering and moving around the venue and
will only be able to remove it when seated to eat or drink. This rule
will come into force from 14 September.

Finally, she announced that while wedding receptions for up to 20 would
be allowed from Monday there would be a pause in the current reopening
route map for other venues meaning that theatres, live music venues,
indoor soft play and contact sports which had been anticipated to reopen
next week will now remain closed until at least 5 October. The pilots on
reopening of sports stadia and other venues will continue over the next
3 weeks and a date for reopening will be kept under review. The updated

SCOTTISH NHS CONTACT TRACING APP LAUNCHED

  The Scottish NHS contact tracing app has launched. The Protect Scotland
app is an extra tool to supplement manual contact tracing and using
bluetooth technology it will alert users that they have been in close
contact with someone who has tested positive for Covid and advise them
to self-isolate. Should they subsequently test positive they will get a
call from a contact tracer. The app will help hospitality businesses
with test and trace requirements but will not replace existing methods
of data capture for customers. For more information on the Protect

WELSH UPDATE

  The Welsh Government has announced changes to face covering rules and
also changes to the maximum limit of people who can meet indoors at one
time.

From Monday 14 September, all residents in Wales over the age of 11,
will be required to wear face coverings in indoor public spaces. This
does not currently include hospitality businesses, however, a review is
being conducted into whether these businesses should be included.

From Monday 14 September, the Government has introduced a maximum limit
of six on the number of people who can meet indoors at any one time.
They must be from the same exclusive household group - or bubble - which
can be made from four households joining together. Children under 11
will not be included in this rule of six. This limit will apply to
indoor settings, including pubs and restaurants. People should only
visit hospitality venues with members of their own household or extended
household. There are currently no changes to the rules for meeting
outdoors.

The Welsh Government published guidance earlier this week for tourism
businesses on taking all reasonable measures to minimise risk to
exposure of Coronavirus [25] in areas where the incidence is higher.
This includes: only accepting guests from low incidence areas, with
hotels and accommodation providers having discretion to refuse admission
from those in high incidence areas or those subject to local
restrictions; making clear that there is no legal obligation on
accommodation providers to check addresses and enforce travel
restrictions but should not knowingly accommodate people who are
breaking the law; reminding guests from areas subject to travel
restrictions of the law and giving them the change to cancel or postpone
bookings.

FORFEITURE EXTENSION IN WALES

  The Welsh Government has extended [26] the forfeiture ban on
non-payment of rent. This means forfeiture for non-payment of rent may
now not be enforced during the period ending 31 December 2020.

EVENTS, CONFERENCES AND SPORT

  During the PM's announcement this week he informed that plans to pilot
larger audiences in venues later this month will be reviewed along with
the intention to return audiences to stadiums and conference centres
from 1 October. That doesn't mean the programme will be scrapped
entirely. The Culture Secretary is expected to provide an update in due
course.

Planned sports pilot events will be limited to smaller, safer numbers,
with strict conditions to ensure social distancing, and will not take
place in areas where incidence is high.

  UKHospitality continues to strongly push Government for a roadmap for
nightclubs.

CONTACTS FOR WEDDING SERVICES

  The Competition and Market Authority [27] (CMA) has issued a statement
setting out the CMA's views on how the law operates
in relation to contracts for wedding services affected by
the coronavirus pandemic.
-------------------------

LOCAL LOCKDOWN RESTRICTIONS

  Caerphilly
No one is allowed to enter or leave Borough Council area; people only be
able to meet outdoors - no indoor meetings even among extended
households; everyone over 11 is required to wear face coverings in
shops. The measures have been introduced following a significant rise in
cases linked to holiday travel abroad and socialising in houses.

East Dunbartonshire and Renfrewshire
New restrictions were introduced in East Dunbartonshire [28] and
Renfrewshire [29], these follow restrictions that were introduced for
people living in Glasgow City, East Renfrewshire and West
Dunbartonshire. The restrictions will be introduced for an initial
two-week period and reviewed in seven days. The local restrictions do
not affect travel in or out of the affected areas, providing the
guidance on mixing with other households in their home is followed.
Anyone on holiday in the affected area do not need to leave but should
follow the recommendations in the guidance and take extra care when
returning home. Guest of self-catering accommodation in unaffected areas
must not mix with different households from affected areas.

Bolton [30]
This week Health and Social Care Secretary Matt Hancock announced new
measures [31] to reduce the spread of COVID-19 in Bolton.
Casinos, skating rinks, bowling alleys, indoor soft play and indoor
performances are not allowed to open. All pubs, bars and restaurants
must close from 10pm to 5am and may only provide takeaway food and
drinks to customers during the day. This includes hotel dining rooms,
members clubs, workplace canteens.

UKHospitality has called [32] on Government to engage with us urgently
to help businesses understand what more they can do, and what triggers
this level of lockdown.

Birmingham
Birmingham has been placed into local lockdown at a key briefing today.
Public Health England data showed on Thursday that Birmingham had the
second highest seven-day infection rate in England, after Bolton.
Birmingham City Council will enforce new restrictions [33] from 15
September, which are primarily centred around banning get-togethers and
meetings indoors and mean households in Sandwell, Birmingham and
Solihull will not be able to mix.

Lifting of restrictions in some areas in the North of England
From Tuesday several businesses and venues that were closed were able to
re-open in Leicester City [34], Blackburn with Darwen, Oldham, Pendle
[35] and other areas in the North of England [36]. Each area has
slightly different changes and it is advised to check the specific area
changes.

TESTING

  The Government has published guidance for individual businesses wanting
to implement their own Coronavirus testing regime for employees [37].
This new guidance goes through all the considerations that businesses
have to take into account if they want to undertake testing of their
staff outside the national testing scheme eg who it will cover, what the
focus of testing will be, whether the programme is voluntary and GDPR
matters.

NEW GRANTS FOR BUSINESSES AFFECTED BY LOCAL LOCKDOWNS

  The Treasury has announced that businesses in England [38] required to
close due to local lockdowns or targeted restrictions will now be able
to receive grants worth up to £1,500 every three weeks. To be eligible
for the grant, a business must have been required to close due to local
COVID-19 restrictions. The largest businesses will receive £1,500 every
three weeks they are required to close. Smaller businesses will receive
£1,000. Currently these payments are available in Blackburn with
Darwen, Pendle, and Oldham as part of an ongoing trial scheme.

CROSS-PARTY SUPPORT VOICED FOR LONG-TERM REDUCTION IN TOURISM VAT

  During a Backbench Business debate this week in the House of Commons,
cross-party support for a long-term reduction in tourism VAT was
expressed. MPs from the Conservative Party, Labour, the SNP and Liberal
Democrats each suggested that an extension of the reduction in VAT
beyond January would be an effective way to protect businesses over the
winter and stimulate the UK's tourist economy. UKHospitality welcomed
[39] the support and believes it is a positive signal that the value of
hospitality and tourism is rightly being recognised. A permanent cut in
VAT would level the playing field with the UK's international
competitors, enabling tourism and hospitality businesses to survive over
the winter, before helping to drive the UK's economic recovery in 2021.

SUPPORT FOR THE TOURISM INDUSTRY DEBATE

  On Thursday, there was a Backbench Business debate focusing on support
for the tourism industry after the Covid-19 lockdown. It was great to
see so many MPs keen to engage on the issue of tourism, which is key to
the local economies of so many parts of the UK. One of the key themes
that emerged from the debate was the cross-party support for an extended
cut in VAT beyond January 2021. MPs from the Conservative Party, Labour,
the SNP and Liberal Democrats each suggested that an extension of the
reduction in VAT beyond January would be an effective way to protect
businesses over the winter and stimulate the UK's tourist economy. This
would be welcomed across the hospitality sector. Ordinarily, the UK has
one of the highest VAT rates in Europe, approximately twice the average
of other major European destinations such as Spain, Germany and Italy,
imposing higher costs and stifling demand. UKHospitality will be working
hard with partners to push for an extension of the VAT cut.

KICKSTART SCHEME UPDATE

  The Kickstart Scheme employer contacts [40] page has been updated to
include a breakdown of English counties, to the local employer contact
list.

CORONAVIRUS JOB RETENTION SCHEME

  A new template is available [41] for download for businesses claiming
for 100 or more employees through CJRS. Employers must now include if an
employee has returned from statutory leave before being put on furlough.


PHE FOOD TARGETS

  Public Health England (PHE) announced new calorie and salt reduction
targets for eating out and takeaway businesses. While UKHospitality
supports [42] objectives to provide healthier choices and nutritional
information for customers. However, it has condemned the timing of the
targets with the country still in the grips of a pandemic and
hospitality businesses struggling to stay afloat.

DEPOSIT RETURN SCHEME ROUNDTABLE

  UKHospitality attended an APPG Beer group roundtable on Deposit Return
Scheme on Wednesday. UKH are heavily involved in working with government
as they design the DRS scheme, sitting on the steering groups in
Westminster and Holyrood. We will also have a presentation from DEFRA at
our next Sustainability group on 16th of September.

stimulating consumer demand to see us through the winter into 2021,
UKHospitality, BII and BBPA are asking hospitality businesses to help
measure the 'state of the nation' ahead of the Autumn Budget. Please
help to bring about positive change for the sector and your business by

SOCIAL IMPACT

  The latest ONS social impact has been published with a number of key
findings including: 29% of employees in hospitality are still on full or
flexible furlough - compared to 11% of employees in all UK businesses
and this rises to 41% in arts and entertainment; 72% of professional and
IT workers are still working from home; job adverts in hospitality are
50% below what they were last year and the weakest sector for
recruitment.

ECONOMIC IMPACT

  ONS Economic Impact [44] research shows how badly tourism-related
businesses are performing compared to the economy as a whole:
accommodation and food service activities industry reported the highest
percentage of businesses reporting their risk of insolvency was severe
to moderate, at 23%, compared with 11% across all industries; 40%
indicated that operating costs had exceeded turnover; 74% of leisure
businesses reporting their turnover had decreased, compared to 46.8% of
businesses as a whole.

TRAVEL CORRIDORS

  This week's review of Travel Corridors page [45] has concluded, with
new countries being removed from the safe travel list and a new islands
policy [46] for England was announced. From 4am on Saturday, travellers
who have been to Portugal (except Azores and Madeira), Hungary, French
Polynesia and Reunion will be required to self-isolate for 14 days.
These removals apply to England only.

In addition, Sweden is added to the safe list of countries exempt from
quarantine effective from 04:00 on Saturday 12th September. Passengers
arriving from Sweden before this time will still need to self-isolate
upon arrival into the UK. Full details here [47].

Border Force will be stepping up enforcement efforts at the border to
ensure arrivals are complying with the quarantine rules.
